The terms that govern your access to and use of the Trailma app, website and related services.

These Terms of Service (“Terms”) govern your access to and use of the Trailma mobile application, website, and related services (collectively, the “Services”), operated by Trailma (“Trailma,” “we,” “us,” or “our”), based in Kathmandu, Nepal.
By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services. Please also review our Privacy Policy, which explains how we collect and use your information.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Trailma. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement and consent of a parent or legal guardian. By using Trailma, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.
2. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must provide accurate and complete information when registering.
- Notify us immediately at support@trailma.com if you suspect unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Description of Services
Trailma is an outdoor activity companion app that allows you to plan, record, and navigate routes (hiking, cycling, running, and similar activities), track GPS-based activity data, connect with other users, and share your outdoor experiences. Features may include activity recording, live/background location tracking, route planning and navigation, social following, clubs and challenges, connected device/health-platform integrations, and aggregated trail heatmaps.
We may add, modify, or discontinue features at any time, with or without notice, though we will make reasonable efforts to notify you of material changes affecting core functionality.
4. Assumption of Risk — Outdoor and Physical Activity
Please read this section carefully.
Trailma provides tools for planning and recording outdoor activities such as hiking, trail running, and cycling. Outdoor activities carry inherent risks, including but not limited to: difficult or changing terrain, weather conditions, wildlife encounters, remote or unmarked trails, physical exertion, equipment failure, and limited or no cell/GPS signal.
By using the Services, you acknowledge and agree that:
- You participate in outdoor activities entirely at your own risk. Trailma does not guarantee the accuracy, safety, completeness, or current condition of any route, trail, map, or navigation data displayed in the app.
- GPS and location data may be inaccurate, delayed, or unavailable, particularly in remote areas, dense forest, canyons, or areas with poor satellite or network coverage. Do not rely solely on Trailma for navigation in hazardous or unfamiliar terrain.
- You are solely responsible for assessing your own fitness, skill level, and preparedness before undertaking any activity, and for carrying appropriate safety equipment, water, navigation backups, and emergency supplies.
- Trailma is not an emergency service. Features such as live location sharing with a trusted contact are convenience tools, not substitutes for official search-and-rescue, emergency services, or personal safety planning. Always inform someone outside the app of your plans when heading into remote areas.
- Trails, routes, or points of interest shown in the app, including user-generated content, may be inaccurate, outdated, on private property, or otherwise unsuitable for public use. Always follow local laws, land-access rules, and posted signage regardless of what the app displays.
To the fullest extent permitted by law, you release Trailma, its officers, employees, and affiliates from any and all liability for injury, loss, or damage arising from your participation in outdoor activities planned or recorded using the Services.
5. User-Generated Content
You retain ownership of the content you create and upload, including routes, activities, photos, videos, comments, and profile information (“User Content”).
By submitting User Content, you grant Trailma a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your User Content solely for the purpose of operating, promoting, and improving the Services (for example, displaying your public activities to your followers, or including de-identified route data in the aggregated Trail Heatmap feature, consistent with our Privacy Policy).
You are solely responsible for your User Content and represent that you have the necessary rights to share it and that it does not violate any law or third party’s rights.
Prohibited Content and Conduct
You agree not to:
- Post content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that infringes another person’s intellectual property or privacy rights.
- Upload false, misleading, or manipulated activity or route data.
- Use the Services to stalk, harass, or endanger another person, including by misusing location-sharing or follower features.
- Attempt to reverse-engineer, scrape, hack, or interfere with the Services or other users’ accounts.
- Use the Services for any commercial purpose without our prior written consent.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
We reserve the right, but not the obligation, to review, remove, or restrict access to any User Content that violates these Terms.
6. Connected Devices and Third-Party Services
Trailma may allow you to connect third-party devices, apps, or platforms (e.g., Garmin, Apple Health, Google Fit, Fitbit). Your use of those third-party services is governed by their own terms and privacy policies, and Trailma is not responsible for their content, accuracy, or practices. You are responsible for managing the permissions and data-sharing settings of any connected service.
7. Subscriptions and Payments (if applicable)
If Trailma offers premium features or a paid subscription tier:
- Prices and features will be clearly disclosed before purchase.
- Subscriptions may auto-renew unless canceled before the renewal date, in accordance with the billing terms of the app store (Google Play) through which you subscribed.
- Refunds are subject to the policies of the applicable app store.
- We may change subscription pricing with advance notice; continued use after a price change constitutes acceptance of the new pricing for future billing cycles.
8. Intellectual Property
The Trailma name, logo, app design, software, and all related intellectual property are owned by Trailma or its licensors and are protected by copyright, trademark, and other laws. Except for the limited license granted to you to use the app for personal, non-commercial purposes, no rights are transferred to you under these Terms.
9. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share information, including precise and background location data, health/fitness data, and social/activity content. By using the Services, you consent to the data practices described there.
10. Termination
You may stop using the Services and delete your account at any time through in-app settings or by contacting support@trailma.com. We may suspend or terminate your access to the Services, with or without notice, if we believe you have violated these Terms, engaged in harmful conduct, or if required by law. Sections of these Terms that by their nature should survive termination (including Sections 4, 8, 11, 12, and 13) will continue to apply.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ROUTE, MAP, GPS, OR TRAIL-CONDITION DATA WILL BE ACCURATE, COMPLETE, OR UP TO DATE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAILMA AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING ANY INJURY OR LOSS SUSTAINED DURING AN OUTDOOR ACTIVITY PLANNED OR RECORDED USING THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Trailma and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your User Content, your violation of these Terms, or your violation of any law or third-party right, including any injury arising from an outdoor activity undertaken using the Services.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Nepal, without regard to its conflict-of-laws principles, except where mandatory local consumer-protection law provides otherwise. Any dispute arising from these Terms or the Services shall first be attempted to be resolved informally by contacting support@trailma.com. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal, unless applicable local law grants you the right to bring a claim in your own jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the app or by email before the changes take effect. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
16. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trailma regarding the Services.
